1. Introduction

This Privacy Policy explains how IMMOBITRON CAMEROON SARL ("IMMOBITRON", "we", "us" or "our") collects, uses, stores, discloses and protects personal information when individuals visit our websites, use virtual tours or digital twins, submit enquiries or listings, interact with our applications and communications, or receive our professional services (collectively, the "Services").

It is intended to support compliance with applicable law, including Cameroon Law No. 2024/017 of 23 December 2024 relating to personal data protection, and other privacy, cybersecurity and electronic-communications requirements that apply to a particular processing activity. Additional notices may apply to a specific campaign, product, location or business relationship.

2. Who We Are and Our Role

IMMOBITRON CAMEROON SARL, Republic of Cameroon, is generally the data controller for website visits, account administration, direct enquiries, marketing, marketplace operation and its own business activities. Contact: contact@immobitron.ai; +237 677 789 008; www.immobitron.ai.

For some client projects, we process property media, lead data or other personal information only on the client's documented instructions. In that situation, the client is generally the controller and IMMOBITRON acts as its processor. Requests concerning that data may need to be directed to the client, though we will provide reasonable assistance.

3. Scope

This Policy covers personal information processed through Immobitron-operated websites, applications, accounts, virtual-tour and digital-twin experiences, capture and media production, marketplace and listing features, enquiries, lead-generation and advertising activities, AI-assisted tools, customer support, events and business operations. It does not govern a third party's independent service, even when linked or embedded; that party's privacy notice applies to its own processing.

4. Personal Information We Collect

Information you provide

  • identity and contact details, such as name, email address, telephone number and preferred language;
  • account credentials, profile details and authentication or verification information;
  • company, role, agency, developer, ownership or authority information;
  • property details, addresses, access instructions, listings, preferences, enquiries and transaction-related communications;
  • billing, invoice and payment-status information (payment providers generally handle complete card or wallet credentials);
  • content, files, instructions, feedback, support requests, reviews and correspondence; and
  • marketing choices, event registrations, survey responses and other information you choose to provide.

Information collected through property capture

  • photographs, 360-degree images, video, audio where intentionally enabled, 3D scans, floor plans, drone imagery and property metadata;
  • incidental images of individuals, vehicles, personal belongings, photographs, documents or other identifying details present at a location; and
  • capture date, location, device, technician and project information needed to create and manage deliverables.

Information collected automatically

  • IP address, browser, operating system, device type, language, approximate region and identifiers;
  • pages, tours, hotspots or listings viewed; clicks, referrals, search activity; session timing; and error or diagnostic logs; and
  • cookie, pixel, local-storage, advertising and analytics information, subject to available consent and preference controls.

Information from others

We may receive information from clients, property owners, agents, developers, advertising and analytics partners, social networks, mapping or capture providers, payment providers, public sources and other users. A person supplying information about someone else must have lawful authority and provide any required notice.

5. Sensitive and Children's Information

Our Services are not designed to collect sensitive personal information unless necessary and lawful for a clearly identified purpose. Please do not submit government identifiers, financial credentials, health information, precise private-location information, biometric data or other sensitive material unless we specifically request it and provide appropriate safeguards.

Our Services are directed primarily to businesses and adults and are not intended for children. We do not knowingly create accounts for children or collect their information without appropriate authorisation. If you believe a child has provided personal information, contact us so we can investigate and take appropriate action. Property clients should ensure that children and other occupants are not captured without the required notice, authority or consent.

6. Purposes and Legal Bases

Depending on the context and applicable law, we process personal information because it is necessary to perform a contract or take requested pre-contract steps; to comply with law; with consent; to protect vital interests; or for legitimate interests that are not overridden by individual rights. Those interests include operating, securing and improving the Services; managing client and partner relationships; preventing fraud; documenting transactions; and marketing our business responsibly.

We use personal information to:

  • create accounts, respond to enquiries, prepare quotations, schedule capture and deliver, host or support Services;
  • create virtual tours, digital twins, property media, listings, staged content, analytics and requested outputs;
  • route and manage leads, communications and marketplace interactions;
  • process billing, confirm payments, maintain records and enforce agreements;
  • personalise experiences, remember preferences and measure product or campaign performance;
  • send service notices and, where permitted, marketing communications;
  • verify authority, moderate content, detect abuse, protect people and systems, and investigate incidents;
  • develop, test, troubleshoot and improve Services, including through aggregated or de-identified analysis; and
  • meet legal, tax, audit, regulatory, dispute and law-enforcement obligations.
7. Property Media and Occupant Privacy

Property owners, agents, developers and other commissioning clients are responsible for providing required notices, obtaining permissions, preparing locations, and removing or securing material that should not be recorded. They should inform occupants of the capture schedule and intended publication. We may blur, remove, restrict or re-capture content where reasonably requested, contractually agreed or legally required, but automated or manual review cannot guarantee that every identifying detail will be detected.

To report an image, document, person or other privacy concern in a tour or listing, send the URL or project identifier, a description and evidence of your relationship to the property or information to contact@immobitron.ai. We may verify identity and authority before acting and may consult the commissioning client.

8. Artificial Intelligence and Automated Processing

We may use AI or machine-learning tools to assist with staging, image enhancement, descriptions, translations, recommendations, lead routing, fraud detection, analytics, valuations or forecasts. Inputs and outputs may contain personal information when a feature requires it. We apply the purpose, access, retention and vendor controls described in this Policy and the relevant service terms.

AI outputs are probabilistic and may be incorrect or biased. We do not intend to make solely automated decisions that produce legal or similarly significant effects on individuals unless we identify a lawful basis, provide required information and safeguards, and offer human review where required. We may use appropriately de-identified or aggregated information to evaluate and improve systems. We will not use identifiable client content to train a general-purpose public model unless disclosed, authorised and lawful.

9. Cookies, Analytics and Advertising

We and authorised partners may use necessary cookies or similar storage for security, network management, authentication and user-requested functionality. With consent where required, we may also use preference, analytics and advertising technologies to understand use, measure campaigns and tailor content or ads. These technologies may collect identifiers, device information, interactions and approximate location and may connect activity across services.

You can use an available cookie banner or preference centre and browser or device settings. Blocking some technologies may affect functionality. Advertising controls do not necessarily stop all advertising; they generally limit personalisation. Where we use services such as Google, Meta, LinkedIn or Realsee, those providers may process information under their own notices as independent controllers for some activities.

10. Marketing Communications

We may send information about relevant Services where you consent or where another lawful basis permits. You may unsubscribe using a message link or by contacting us. We may retain a suppression record so we respect the choice. Opting out of marketing does not stop necessary service, security, billing or legal communications.

11. How We Share Information

We may disclose personal information only as reasonably necessary to:

  • clients and authorised users for whom a tour, campaign, listing, lead or other Service is provided;
  • capture, hosting, cloud, communications, support, AI, mapping, analytics, advertising, payment and professional-service providers bound by appropriate obligations;
  • marketplace participants when a user submits an enquiry or chooses to communicate;
  • affiliates, contractors and personnel who need the information for their work;
  • professional advisers, auditors, insurers, investors and counterparties in a proposed financing, reorganisation or sale, subject to confidentiality and lawful safeguards;
  • courts, regulators, law-enforcement bodies or other authorities where required or permitted by law; or
  • protect rights, safety, property, users and the integrity of the Services, or establish, exercise or defend legal claims.

Public tours and listings are intentionally available to viewers and may be copied or indexed by others. Clients should choose access restrictions where confidentiality is required. We do not sell personal information for money. Some advertising disclosures may be treated as 'sharing' or a similar regulated activity in certain jurisdictions; where applicable, we provide required notice and choices.

12. International Transfers

Our operations and providers may process information in Cameroon and other countries. Where personal information is transferred across borders, we take reasonable and legally required steps to assess the transfer and use appropriate safeguards, which may include contractual protections, approved transfer mechanisms, consent or another lawful basis. Information may be subject to the laws and lawful access requirements of the destination country.

13. Data Retention

We retain personal information only for as long as reasonably necessary for the purpose collected, including to provide active Services, honour access or hosting periods, maintain financial and contractual records, resolve disputes, prevent fraud and meet legal obligations. We consider the type, sensitivity, volume and risk of the information, the relationship and applicable limitation or retention periods.

Typical periods may differ by record: account and client records are generally kept for the relationship and a reasonable legal-record period; enquiries and leads are kept while active and then for a limited follow-up or defence period; security logs are usually shorter-lived; and hosted tours remain available for the contracted hosting period. Backups may persist for a limited cycle before deletion. We may retain de-identified information that no longer identifies an individual.

14. Security and Incident Response

We use administrative, technical and organisational measures proportionate to the nature and risk of the information, such as access controls, least-privilege practices, credential protection, secure hosting, encryption where appropriate, logging, vendor review, confidentiality obligations, backups and incident procedures. No system is completely secure. Users should protect credentials and promptly report suspicious activity.

If we identify a personal-data breach, we will investigate, contain and document it and notify affected clients, individuals or competent authorities where and within the time required by applicable law. Notice may be delayed where law-enforcement or security needs lawfully require it.

15. Your Rights

Subject to applicable law and exceptions, you may have rights to:

  • receive information about processing and access personal information;
  • correct incomplete or inaccurate information;
  • request deletion, restriction or cessation of processing;
  • object to processing based on particular grounds, including certain direct marketing;
  • withdraw consent without affecting earlier lawful processing;
  • receive or transmit portable information where the legal conditions apply;
  • seek human review of certain solely automated decisions; and
  • complain to a competent personal-data protection authority or seek another remedy.

To make a request, email contact@immobitron.ai and describe the information or Service involved. We may verify identity and authority, ask for clarification, consult the relevant client controller, or refuse or limit a request where law permits. We will respond within the period required by applicable law. We will not discriminate against a person for exercising a privacy right.

16. Client-Controlled Data

If your information appears in a Service operated for an Immobitron client, that client may control the purpose and key decisions. Contacting the client may be the fastest route. If you contact us, we may forward the request to the client and assist it under our agreement. Business clients must use the Services in a way that permits us to meet our processor and security obligations.

17. Third-Party Links, Embeds and Social Features

The Services may include third-party maps, videos, social plugins, payment pages, messaging tools or links. A third party may collect information when its feature loads or when you interact with it. We do not control that independent processing. Review the provider's privacy and cookie information before using the feature.

18. Business Changes

If IMMOBITRON is involved in a merger, investment, restructuring, financing, sale or transfer of all or part of its business or assets, personal information may be reviewed or transferred subject to confidentiality, applicable law and appropriate notice. The recipient may use it only consistently with this Policy unless another lawful notice is provided.

19. Changes to This Policy

We may update this Policy to reflect changes in law, technology, Services or business practices. The latest version will be posted with its effective date. We will provide additional notice of material changes where reasonably practicable or legally required and will seek consent where a new use requires it.

1. Acceptance and Scope

These Terms of Service ("Terms") govern your access to and use of websites, applications, accounts, virtual tours, 3D digital twins, property media, marketplaces, artificial-intelligence tools, analytics, advertising, lead-generation, hosting and other products or services made available by IMMOBITRON CAMEROON SARL ("IMMOBITRON", "we", "us" or "our") (collectively, the "Services").

By accessing or using the Services, creating an account, submitting an order, accepting a quotation, or otherwise indicating agreement, you accept these Terms. A signed proposal, order form, quotation, statement of work or service agreement may add service-specific terms. If there is a conflict, that signed document controls for the relevant Services, followed by these Terms and then any other referenced policy.

If you do not agree, do not use the Services. Our Privacy Policy explains how we process personal information and forms part of the framework governing use of the Services.

3. Eligibility and Authority

You must be at least 18 years old and legally capable of entering a binding agreement. If you use the Services for an organisation, you represent that you have authority to bind it. You may not use the Services if applicable law prohibits you from doing so.

4. Accounts and Security

Where an account is available, you must provide accurate information, keep credentials confidential, promptly update material changes, and notify us of suspected unauthorised access. You are responsible for activity under your account unless caused by our breach of duty. We may require identity, authority, property-rights or payment verification and may reject, restrict or suspend an account where verification is incomplete or risk is identified.

5. Services and Changes

The Services may include:

  • virtual tours, 360-degree imagery, 3D scanning, digital twins, floor-plan or spatial outputs and hosting;
  • property photography, videography, drone or aerial imaging, editing and virtual staging;
  • property listings, discovery, enquiries, marketplace and communication tools;
  • digital advertising, campaign management, lead generation and performance analytics;
  • AI-assisted content, recommendations, valuation estimates, market insights, automation and related property tools; and
  • professional, enterprise, integration, data and other technology services described in an order or introduced from time to time.

Features, technical requirements and availability may evolve. We may modify, replace, suspend or discontinue a Service where reasonably necessary for security, legal compliance, third-party dependency, maintenance or business reasons. For paid Services, we will use reasonable efforts to provide notice of a material reduction that affects an active service period.

6. Client Responsibilities and Property Access

A client commissioning capture, marketing or publication represents and warrants that it owns the relevant property or content, or has all authority and permissions required for access, capture, processing, publication and the intended use. The client must:

  • provide accurate property, access, safety, scheduling and contact information;
  • obtain required permissions from owners, tenants, occupants, employees, visitors, building managers and authorities;
  • secure or remove confidential records, valuables, personal photographs and other material not intended to appear;
  • disclose hazards, restricted areas and site rules before attendance;
  • ensure lawful drone access and location-specific approvals where the client is responsible for them under an order; and
  • review proofs or deliverables within any stated approval period and promptly identify requested corrections.

We may postpone or stop work where a site is unsafe, access is unauthorised, weather or regulatory conditions prevent capture, or continuing would create unreasonable risk. Additional attendance or rework caused by inaccurate information, lack of readiness or changed instructions may be charged.

7. User Content and Listings

"User Content" means listings, descriptions, images, logos, files, reviews, messages, instructions and other material supplied or posted by a user. You retain ownership of your User Content. You grant IMMOBITRON a worldwide, non-exclusive, royalty-free licence to host, reproduce, adapt, format, transmit, display and otherwise process User Content only as reasonably necessary to provide, secure, improve and promote the contracted Services, comply with law, and exercise our rights under these Terms.

You represent that User Content is accurate in all material respects, does not infringe rights, and may lawfully be processed for the requested purpose. You remain responsible for listing prices, availability, title or ownership claims, mandatory disclosures, and communications with other users. We may remove or restrict content that is unlawful, misleading, unsafe, infringing, technically harmful or contrary to these Terms.

8. Immobitron Content and Intellectual Property

IMMOBITRON and its licensors retain all rights in the Services and in software, interfaces, templates, capture and editing methods, models, workflows, databases, branding and technology used to provide them. Subject to payment and any order-specific restrictions, we grant the client a limited, non-exclusive, non-transferable licence to use final deliverables for the agreed business purpose. Drafts, raw capture files, source files and working materials are not included unless expressly stated in writing.

Except as permitted by law or in writing, you may not copy, resell, sublicense, scrape, extract, reverse engineer, remove rights notices from, or create a competing dataset or service from the Services or IMMOBITRON content.

9. Portfolio Use and Confidential Projects

Unless a signed agreement states otherwise, we may identify completed public-facing projects and display representative deliverables in our portfolio, website, social channels, pitches and award submissions after public release. We will not intentionally publish client confidential information for this purpose. A client requiring confidentiality, embargoes or restricted access must agree those requirements in writing before capture or production.

10. Virtual Tours, Digital Twins and Spatial Outputs

Immersive media is a visual representation created from available capture conditions and processing tools. Unless expressly sold as a certified professional measurement service, outputs are not surveys, architectural records, engineering models, condition reports or guarantees of dimensions, accessibility, boundaries, defects or regulatory compliance. Visual staging and edits may depict illustrative furniture, finishes, lighting or conditions that do not exist. Users must independently verify material facts before purchasing, leasing, investing, constructing or making other decisions.

11. Artificial Intelligence and Automated Features

Some Services may use third-party or proprietary AI to generate or assist with descriptions, images, staging, recommendations, classifications, valuations, forecasts, translations or analytics. AI output may be incomplete, inaccurate, outdated or unsuitable. It is not legal, financial, investment, valuation, surveying, engineering or other professional advice and must be reviewed by a qualified person where material decisions are involved.

You must not submit confidential, personal or third-party material to an AI feature unless authorised and the feature is intended to receive it. You are responsible for reviewing AI output before publication and for complying with disclosure, intellectual-property, fairness and other legal requirements. We may use service data to operate, test, secure and improve AI features as described in the Privacy Policy and applicable agreements; we do not claim ownership of User Content merely because it is processed by AI.

12. Marketplace and Communications

Unless we expressly agree otherwise in writing, IMMOBITRON provides technology and marketing tools and is not a property owner, seller, landlord, buyer, tenant, broker, escrow provider, lender, valuer or party to a user transaction. We do not guarantee user identity, authority, listing accuracy, property condition, legal title, financing, payment, availability or transaction outcome. Users must conduct due diligence, use appropriate professionals, document agreements, and take reasonable anti-fraud precautions.

Users may receive service, enquiry or transaction communications. Marketing communications are sent subject to applicable law and available preference controls. Users must not use contact details obtained through the Services for spam, harassment, unlawful discrimination or unrelated solicitation.

13. Lead Generation and Advertising

Campaign reach, lead volume, lead quality, conversion, platform approval and sales outcomes are not guaranteed. Advertising and analytics depend on audience, budget, creative, market conditions, tracking settings and third-party platforms. The client is responsible for lawful claims, offers, targeting instructions, landing pages, consents and prompt handling of leads. Unless an order states otherwise, media spend, taxes and third-party platform charges are separate from our fees.

14. Fees, Taxes and Payment

Fees, currency, milestones and payment dates are set out in the applicable quotation, invoice or agreement. Unless stated otherwise, fees exclude taxes, duties, media spend, travel outside the agreed area and third-party charges. You authorise us and our payment providers to process payments and related information. Overdue amounts may accrue lawful collection costs or charges stated in an order, and we may pause production, publication, hosting or access after reasonable notice.

Deposits and amounts attributable to completed work, reserved production time, purchased media or non-cancellable third-party costs are non-refundable to the extent permitted by law. Any consumer rights that cannot lawfully be excluded remain unaffected.

15. Subscriptions, Hosting and Cancellation

Recurring Services renew for the period and at the price disclosed at purchase or in an order, unless cancelled in accordance with that order. We will give notice of material price changes where required. Cancellation stops future renewal but does not normally create a refund for the current period. On expiry, cancellation or non-payment, hosted content may be disabled and later deleted after reasonable notice. Clients should retain copies of deliverables they are entitled to keep.

16. Third-Party Services

The Services may interoperate with mapping, capture, social-media, advertising, analytics, communications, cloud, AI and payment providers, including services such as Realsee, Google, Meta and LinkedIn. Third-party services are governed by their own terms and may change or fail independently of us. We are not responsible for third-party acts or policies, but this does not limit responsibility that applicable law places on us for our selection or use of processors.

17. Acceptable Use

You must not:

  • break the law, infringe rights, misrepresent a property or impersonate another person;
  • upload malware, bypass security, probe systems without authorisation, or disrupt the Services;
  • scrape, harvest, index or use automated means beyond published interfaces or written permission;
  • use the Services or outputs to facilitate fraud, unlawful surveillance, discrimination, harassment or unsafe activity;
  • submit unlawful personal data, intimate imagery, secrets or content captured without required notice or consent;
  • use outputs to train or benchmark a competing model or service except with written permission; or
  • remove watermarks, notices or technical restrictions, or conceal that staged or synthetic content is illustrative where disclosure is required.
18. Moderation, Complaints and Intellectual-Property Notices

We may investigate reported content or conduct and take proportionate action, including requesting evidence, restricting visibility, preserving records, removing content, or suspending access. To report an infringement, privacy concern, fraudulent listing or unsafe content, email contact@immobitron.ai with the relevant URL or project, a description of the issue, supporting evidence, and your contact details. We may forward the substance of a complaint where reasonably necessary to resolve it.

19. Availability, Maintenance and Beta Features

We aim to provide reliable Services but do not promise uninterrupted or error-free operation. Maintenance, connectivity, device compatibility, force-majeure events and third-party dependencies may affect availability. Preview, pilot or beta features may be changed or withdrawn and are provided for evaluation unless stated otherwise. Service credits or support commitments apply only where included in a signed service-level agreement.

20. Disclaimers

To the maximum extent permitted by law, the Services are provided "as is" and "as available". We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy and uninterrupted availability. Nothing in these Terms excludes a warranty, remedy or liability that cannot lawfully be excluded or limited.

21. Limitation of Liability

To the fullest extent permitted by law, IMMOBITRON and its affiliates, officers, employees and contractors will not be liable for indirect, incidental, special, exemplary, punitive or consequential loss, or loss of profit, revenue, opportunity, goodwill, anticipated savings or data, arising from the Services. Our aggregate liability arising from the event or series of related events will not exceed the fees paid or payable for the affected Service during the 12 months before the event.

The limitations do not apply to fraud, wilful misconduct, death or personal injury caused by negligence, breach of confidentiality or data-protection duties where liability cannot be limited, or any other liability that applicable law prohibits us from limiting.

22. Indemnity

To the extent permitted by law, a business user will defend and indemnify IMMOBITRON against third-party claims, damages and reasonable costs arising from that user's unlawful User Content, lack of property or publication authority, breach of Sections 6, 7 or 17, or violation of another person's rights. We will promptly notify the user and allow reasonable control of the defence, subject to our right to participate and to approve any settlement imposing liability or obligations on us.

23. Suspension and Termination

We may suspend or terminate access where reasonably necessary because of material breach, non-payment, fraud, security risk, unlawful content, legal requirement, harm to users or the Services, or discontinuation. Where practical, we will provide notice and an opportunity to cure. You may stop using free Services at any time and may cancel paid Services under the applicable order. Provisions concerning payment, ownership, licences needed to wind down, disclaimers, liability, indemnity, disputes and interpretation survive termination.

24. Privacy and Data Protection

Our processing of personal information is described in the Privacy Policy. Clients that provide personal information must do so lawfully and provide required notices. Where IMMOBITRON processes personal information solely on a business client's documented instructions, the parties may enter into a data-processing agreement. Each party remains responsible for its own compliance with applicable privacy, electronic-communications and cybersecurity laws.

25. Confidentiality

Each party will use the other's non-public business, technical and commercial information only for the relevant Services and will protect it with reasonable care. This obligation does not cover information that is public without breach, already lawfully known, independently developed, or lawfully received without confidentiality duty. Disclosure may be made to personnel and advisers who need to know and are bound by appropriate duties, or where legally required after notice where permitted.

26. Force Majeure

Neither party is liable for delay or failure caused by events beyond reasonable control, including natural disaster, severe weather, epidemic, conflict, civil unrest, government action, utility or internet failure, cyberattack not caused by a failure to use reasonable safeguards, labour disruption or third-party platform outage. Payment for Services already delivered remains due.

27. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Cameroon, without regard to conflict-of-law rules. The parties will first attempt in good faith to resolve a dispute through written notice and discussion. Unless a signed agreement provides otherwise, the competent courts of Cameroon have jurisdiction. Mandatory consumer or data-protection rights and access to competent authorities remain unaffected.

28. Changes to These Terms

We may update these Terms to reflect changes in law, Services, technology or risk. The current version will be posted with its effective date. We will provide additional notice of material changes where reasonably practicable or legally required. Changes do not retroactively alter an agreed paid service period unless required by law or accepted by the client. Continued use after the effective date constitutes acceptance where permitted by law.

29. General

These Terms and incorporated service documents are the entire agreement on their subject matter. Failure to enforce a provision is not a waiver. If a provision is unenforceable, it will be limited to the minimum extent necessary and the remainder will continue. You may not assign your agreement without our consent, except in connection with a permitted business reorganisation that does not reduce performance. We may assign it to an affiliate or successor, subject to applicable law. Headings are for convenience; 'including' means 'including without limitation'. Electronic notices and signatures may be used where lawful.
